IN RESPONSE to the latest talc lawsuit in the US against Johnson & Johnson (J&J), the company has offered claimants one of the largest payouts in the history of mass tort litigation (PD 23 May).
Erik Haas, Worldwide Vice President of Litigation told Pharmacy Daily, "J&J has prevailed in 16 of 17 ovarian cancer trials, and we will move to dismiss this latest 'Hail Mary' frivolous filing".
He said the latest filing was signed by the same small group of plaintiffs' lawyers who have fought every effort to resolve this litigation to date.
Haas added, law firm Beasley Allen, the "ringleader" of these efforts, is putting its own financial motive ahead of its clients, as it stands to lose hundreds of millions of dollars in attorney fee recoveries if the claimants are paid via a bankruptcy trust.
