The Therapeutic Goods Administration (TGA) has posted an invitation to interested parties to comment on the handling of issues under a new complaints management system for therapeutic goods advertisements directed to the public and other recommended reforms to the advertising regulatory framework. A new centralised advertising complaints-management process has been proposed along with other recommendations by an Expert Panel, which was assessing the regulatory framework for medicines and medical devices and made a total of 58 recommendations in two reports. The Panel’s recommendations, intending to simplify the advertising regulatory framework, were to cease pre-approval in favour of a more self-regulatory approach and implementation of a more transparent and efficient complaints management process. In addition the Panel sought greater consistency across regulation of advertising of different types of therapeutic goods, a formal education program for industry to encourage compliance and a broadening and enhancing of the TGA’s investigation and enforcement powers.
