Practicing proprietor rules

THE Pharmacy Board of Australia
has issued a consultation draft of its
guideline regarding the
responsibilities of pharmacists when
practicing as proprietors.
Under the draft guideline a
registered pharmacist who is a
proprietor must maintain an
awareness of the manner in which
his or her pharmacy business is
being conducted, “and where
necessary, intervene to ensure the
practice of pharmacy is conducted
in accordance [with] applicable
laws and guidelines”.
The new guideline also stipulates
that because pharmacy ownership
is a role which “impacts on safe,
effective delivery of services in the
profession and involves the use of
professional skills” that a
“pharmacist who owns a pharmacy
is practicing pharmacy”.
As such pharmacy owners must
understand the range of goods sold
and services provided in their
business including non-traditional
and novel goods and services, and
must ensure that the pharmacy is
resources suitably and staff training
is sufficient to provide services and
sell products.
Pharmacist proprietors must also
understand the liability associated
with the sale of goods and provision
of services; maintain a direction
over what types of goods are sold
and services provided and must
also ensure that the business
procedures and policies that they
have put in place are being
adhered to.
The Guideline also states that all
procedures and policies relevant to
the conduct of the pharmacy are
documented and available within
the pharmacy, and that an owner
or part-owner of a pharmacy
cannot abdicate his or her
professional obligations.
The Board is now calling for
submissions of comment on the
draft guideline by no later than 29
